1. 关于 PicPoem1. About PicPoem
PicPoem 是一个帮助用户记录生活瞬间的创作应用。
PicPoem is a creative app that helps users record moments from everyday life.
PicPoem 提供：
PicPoem provides:
- 每日作品体验；A daily artwork experience;
- 图片排版；Photo layouts;
- 文字呈现；Text presentation;
- 个人作品保存；Personal artwork storage;
- 作品导出与分享功能。Artwork export and sharing.
2. 用户账户2. User Accounts
当前版本中：
In the current version:
- PicPoem 不要求用户创建账号；PicPoem does not require users to create an account;
- 用户作品主要保存在用户设备中。Users' artwork is primarily stored on their devices.
如果未来 PicPoem 提供用户账户、云端同步或其他在线服务，我们可能更新相关条款。
If PicPoem offers user accounts, cloud synchronization, or other online services in the future, we may update the relevant terms.
3. 用户内容与责任3. User Content and Responsibilities
3.1 用户拥有的内容3.1 Content Owned by Users
你上传、选择或导入 PicPoem 的照片，其所有权仍归你或原权利人所有。
Ownership of photos you upload, select, or import into PicPoem remains with you or the original rights holder.
PicPoem 不拥有你的个人照片。
PicPoem does not own your personal photos.
3.2 用户责任3.2 User Responsibilities
你需要确保：
You must ensure that:
- 你拥有所上传照片的合法使用权；You have the legal right to use the photos you upload;
- 你已获得照片中其他个人必要的授权；You have obtained any necessary authorization from other people shown in the photos;
- 你的内容不会侵犯第三方权益。Your content does not infringe the rights of third parties.
你不得使用 PicPoem 创建或传播：
You must not use PicPoem to create or distribute:
- 违法内容；Unlawful content;
- 侵犯他人隐私的内容；Content that infringes others' privacy;
- 侵犯版权、商标或其他知识产权的内容；Content that infringes copyright, trademarks, or other intellectual property rights;
- 欺诈、骚扰或其他不当内容。Fraudulent, harassing, or otherwise inappropriate content.
4. PicPoem 生成作品4. Artwork Created with PicPoem
PicPoem 生成的作品可能包含：
Artwork created with PicPoem may contain:
- 用户提供的照片；Photos provided by users;
- PicPoem 提供的排版设计；Layout designs provided by PicPoem;
- PicPoem 提供的文字内容；Text content provided by PicPoem;
- PicPoem 品牌元素。PicPoem brand elements.
4.1 用户照片4.1 User Photos
用户上传的照片：
For photos uploaded by users:
版权及相关权利归用户或原权利人所有。
Copyright and related rights belong to the user or the original rights holder.
4.2 用户创作作品4.2 Artwork Created by Users
由用户照片生成的最终作品：
For final artwork created from users' photos:
用户可以：
Users may:
- 保存；Save it;
- 分享；Share it;
- 用于个人用途。Use it for personal purposes.
但用户不得：
However, users must not:
- 冒充 PicPoem 官方内容；Present it as official PicPoem content;
- 删除版权标识后用于误导性商业宣传；Remove copyright notices and then use it for misleading commercial promotion;
- 将 PicPoem 的设计系统、排版方式或视觉资源作为独立产品提供给第三方。Offer PicPoem's design system, layout methods, or visual resources to third parties as a separate product.
4.3 PicPoem 产品内容4.3 PicPoem Product Content
PicPoem 拥有或获得授权使用：
PicPoem owns or is authorized to use:
- App 软件；The App software;
- 产品设计；Product design;
- 用户界面；The user interface;
- Logo；The Logo;
- 品牌名称；The brand name;
- 排版系统；The layout system;
- 视觉资源。Visual resources.
未经 PicPoem 授权，不得：
Without PicPoem's authorization, you must not:
- 复制；Copy them;
- 分发；Distribute them;
- 商业使用；Use them commercially;
- 反向工程；Reverse engineer them;
- 创建类似服务。Create similar services.
5. 文学作品与内容来源声明5. Literary Works and Content Sources
PicPoem 尊重每一位创作者及其知识产权。
PicPoem respects every creator and their intellectual property rights.
App 中展示的部分文字内容可能来自：
Some text displayed in the App may come from:
- PicPoem 原创文字；Original writing by PicPoem;
- 公共领域文学作品；Literary works in the public domain;
- 已获得授权的作品；Works used with permission;
- 其他合法来源内容。Other lawful sources.
对于非 PicPoem 原创内容，PicPoem 会尽可能标注：
For content that is not original to PicPoem, PicPoem will identify the following wherever possible:
- 作者姓名；The author's name;
- 作品名称；The title of the work;
- 来源信息。Source information.
5.1 关于文学作品版权5.1 Copyright in Literary Works
部分文学作品可能仍受到版权保护。
Some literary works may still be protected by copyright.
即使标注：
Even if the following are credited:
- 作者；The author;
- 出处；The source;
- 作品名称；The title of the work;
也不代表自动获得相关版权授权。
This does not automatically mean that the relevant copyright permission has been obtained.
PicPoem 会尽可能选择：
PicPoem will seek to use:
- 合法来源内容；Content from lawful sources;
- 公共领域作品；Works in the public domain;
- 已获得使用许可的内容。Content for which permission to use has been obtained.

PicPoem 可能提供每日更新内容，包括：
PicPoem may provide content updated daily, including:
- 图片；Images;
- 诗句；Poems;
- 排版设计；Layout designs;
- 视觉元素。Visual elements.
这些内容属于 PicPoem 或相关权利方。
This content belongs to PicPoem or the relevant rights holders.
未经授权，不得：
Without authorization, you must not:
- 批量抓取；Scrape it in bulk;
- 商业转载；Republish it commercially;
- 重新销售；Resell it;
- 创建竞争性内容服务。Create a competing content service.
7. 分享与公开展示7. Sharing and Public Display
PicPoem 鼓励用户分享自己的作品。
PicPoem encourages users to share their own artwork.
当你主动保存或分享作品时，相关操作由你自主决定。
When you choose to save or share artwork, you make that decision yourself.
分享后的内容如何被第三方平台处理，由对应平台规则决定。
How a third-party platform handles shared content is governed by that platform's rules.
8. 付费功能8. Paid Features
PicPoem 可能提供付费功能，例如：
PicPoem may offer paid features, such as:
- 移除作品水印；Removing artwork watermarks;
- 增加创作次数限制；Increasing creation limits;
- 解锁未来高级创作能力。Unlocking future advanced creative capabilities.
具体权益以 App 内展示内容为准。
The specific benefits are those displayed in the App.
8.1 购买方式8.1 Purchases
所有购买通过 Apple App Store 完成。
All purchases are made through the Apple App Store.
PicPoem 不保存：
PicPoem does not store:
- 银行卡信息；Bank card information;
- 支付密码；Payment passwords;
- Apple ID 密码。Apple ID passwords.
8.2 权益变化8.2 Changes to Benefits
为了持续优化产品，PicPoem 可能：
To continue improving the product, PicPoem may:
- 增加新的功能；Add new features;
- 优化已有功能；Improve existing features;
- 调整未来服务内容。Adjust future service offerings.
已购买权益将按照购买时展示的信息处理。
Purchased benefits will be handled in accordance with the information displayed at the time of purchase.
9. 使用限制9. Restrictions on Use
使用 PicPoem 时，你同意：
When using PicPoem, you agree:
- 不破解或修改 App；Not to crack or modify the App;
- 不绕过付费限制；Not to bypass paid feature restrictions;
- 不利用漏洞获取未授权权益；Not to exploit vulnerabilities to obtain unauthorized benefits;
- 不干扰 App 正常运行；Not to interfere with the App's normal operation;
- 不进行恶意自动化访问。Not to engage in malicious automated access.
10. 软件所有权10. Ownership of the Software
PicPoem App 及相关内容，包括：
The PicPoem App and related content, including:
- 软件代码；Software code;
- 产品设计；Product design;
- 品牌元素；Brand elements;
- 视觉系统；The visual system;
- 内容资源；Content resources;
均属于 PicPoem 或其授权方。
All of these belong to PicPoem or its licensors.
本条款不构成任何形式的所有权转让。
These terms do not transfer ownership in any form.
11. 服务变化11. Changes to the Service
为了改善产品体验，PicPoem 可能：
To improve the product experience, PicPoem may:
- 更新应用；Update the App;
- 调整功能；Adjust features;
- 增加新的服务；Add new services;
- 停止部分功能。Discontinue certain features.
12. 服务可用性12. Service Availability

We will work to keep PicPoem running reliably.

- 网络环境；Network conditions;
- 第三方服务；Third-party services;
PicPoem 不保证服务始终无中断或完全无错误。
PicPoem does not guarantee that the service will always be uninterrupted or entirely error-free.

PicPoem 提供的是记录与创作工具。
PicPoem provides a tool for recording and creating.
用户应自行判断生成作品的使用方式。
Users should decide for themselves how to use the artwork they create.
PicPoem 不保证：
PicPoem does not guarantee:
- 每次生成结果完全符合个人预期；That every result will fully meet individual expectations;
- 所有设备环境下表现完全一致；Identical performance across all device environments;
- 第三方平台始终正常运行。That third-party platforms will always operate normally.
14. 未成年人使用14. Use by Minors
如果用户未达到所在地法律规定的年龄要求，应在监护人的同意和指导下使用 PicPoem。
Users who have not reached the age required by local law should use PicPoem with the consent and guidance of a guardian.
15. 使用条款更新15. Updates to These Terms of Use
我们可能根据：
